Islamabad: Islamabad District and Sessions Court Judge Muhammad Afzal Majoka said the Imran Khan-Bushra Bibi Nikkah Iddat case will be announced on July 12.
The District and Majlis Court on Wednesday adjourned till July 8 the hearing of the appeal against Pakistan Tehreek-e-Insaf founder Imran Khan and his wife Bushra Bibi in the Nikkah Iddat case.
Earlier, an Islamabad court on June 27 rejected a plea by PTI founder Imran and his wife Bushra Bibi to remain in iddat (mandatory waiting period for Muslim women between two marriages).
Additional District and Sessions Judge Muhammad Afzal Majoka presided over today’s hearing.
PTI advisor Salman Akram Raja. Yesterday, King argued in part against the refusal to stay the verdict.
At the beginning of the hearing, the King’s Advocate started his argument by referring to Section 7 of the Muslim Family Code.
“Are you saying Article 7 doesn’t apply in this case?” asked Hakim Majoka.
Citing various court decisions in Muslim law, Raja argued that family law is part of personal law and falls under the jurisdiction of the Sharia Court.
In line with an earlier ruling by the country’s highest court, the Union Council said the separation will be effective even if the case is not over.
The court held that Section 7 cannot be used for coercion.
Judge Majoka said in one case a woman claimed maintenance despite no Section 7 notice and the court granted her maintenance.
The king argued that a woman could marry without a certificate from the Union Council, and the cancellation of thousands of marriages every year would create many inheritance problems.
The court referred to the case of Allahd Kaka, which decided that the Iddat (waiting period) begins from the death of the husband. Various interpretations of the iddat period have been discussed, including 39 days and three menstrual cycles.
