ISLAMABAD: The Islamabad High Court (IHC) on Thursday directed the authorities to remove senior lawyer Sardar Latif Khosa from the exit control list and allow him to travel abroad. However, the court called upon the petitioner to submit an affidavit to this trial court that he would appear before it whenever summoned. IHC Judge Mohsin Akhtar Kayani heard a case seeking removal of Mr. Khosa’s name from the ECL. The public prosecutor told the court that the appellant’s name is in the list as proposed in the FIR. He said the case has yet to be heard in the court of first instance. Justice Kayani said that this case involved violation of section 144 and asked about 7ATA. He asked the police if it was necessary to arrest the complainant. On this, the legal Islamabad police DSP said that the police will not arrest him but will take instructions in this regard. The court questioned whether the petitioner would flee abroad or not return. The appellant’s lawyer said his client was not allowed to board because his flight was scheduled for January 5. The court allowed Latif Khosa to travel overseas and also ordered him to submit an affidavit to the trial court. The petition was processed according to the above instructions. It may be mentioned here that the Secretariat Police Station has registered a case under Section 144 against Latif Khosa for protesting outside the Supreme Court of Pakistan building.
