The Lahore High Court has rejected a husband’s claim that he had divorced his wife as a joke through email, upholding the decision of the relevant Union Council that the divorce was legally effective.
The court dismissed a petition filed by Raheel Ahmed challenging the Union Council’s decision and maintained its certificate declaring the divorce effective.
Court Says Wife Cannot Be Left in Legal Uncertainty
In its ruling, the Lahore High Court observed that a woman cannot be left in uncertainty regarding her marital status.
The court noted that if a husband fails to notify the Union Council about a divorce, the wife can inform the council herself and initiate the relevant legal process.
According to the ruling, the husband cannot use his own legal failure or omission as a means of preventing the divorce process from taking effect.
The court also held that a Family Court cannot simply refuse to determine whether a divorce has taken place when the matter falls within its jurisdiction.
Husband Sent Divorce Through Email
According to the case record, Raheel Ahmed sent a divorce declaration to his wife via email but did not notify the Union Council as required.
The woman later approached the Family Court over her dowry articles and other claims.
The Family Court directed the parties to approach the Union Council regarding the effectiveness of the divorce while deciding the other issues before it.
The Union Council subsequently declared the divorce effective after the husband failed to appear before it.
Court Rejects “Joke” Argument
The husband argued that the divorce statement made through email was intended as a joke.
The Lahore High Court rejected this position and maintained that the legal process surrounding divorce cannot be left uncertain merely because one party later claims that the statement was not intended seriously.
The court also observed that the 90-day reconciliation period provided under the law is intended to facilitate reconciliation and complete the legal process, not to create indefinite uncertainty about a woman’s marital status.
Recommendations for Legal Reform
The Lahore High Court recommended that the government consider amendments to the relevant divorce law.
The court also ordered that a copy of the judgment be sent to all Family Courts in Punjab to serve as guidance in similar cases.
The ruling emphasized that delays or procedural omissions by a husband should not be used to keep a woman in prolonged uncertainty over her legal marital status.
