Judge Jamal Khan Mandokhail stressed on Tuesday that the suspect cannot be tested under the Army Act until the accusation is framed against them. Judge SC made these notes during hearing on intra-conceive appeal against a court with civilians in military courts, on Tuesday’s peak of the constitutional bench. The seven -member bench was led by Judge Aminuddin Khan and included Judge Jamal Mandokhel, Judge Muhammad Ali Mazhar, Judge Hassan Azhar Rizvi, Judge Musarrat Hilali, Judge Naeem Akhtar Afghan and Judge Shahid Bilal. Attorney Khawaja Haris presented his arguments, explained the army -related process, and how the accusations are framed by the police and federal investigative agency (FIA). Judge Hilali then asked if the accusation could be framed during the court proceedings. For this purpose, Haris replied that accusations as in accusations against the suspect are another thing, while further framing the accusation or accusation during the court proceedings is another. The discussion then moved to a military court judge and asked the judge whether the lawyers of the military court wore uniforms.
