ISLAMABAD: The Lahore High Court has dismissed a plea filed by Bushra Bibi, wife of PTI founder Imran Khan, after she withdrew her petition challenging her arrest in the third Toshakhan case.
The petition also sought legal action against the Adiala jail warden and female staff for allegedly ill-treating her after her re-arrest after acquittal in the Iddat case.
The registrar of the court objected and said that the Lahore High Court was not the appropriate forum for such a cause.
Bushra Bibi, represented by senior lawyer Sardar Latif Khan Khosa, asked the court to declare her arrest illegal and quash all further investigations, FIRs or arrest warrants related to the case.
In her petition, she named several respondents, including the Inspector General of Police Punjab, the Superintendent of Adiala Jail, the Government of Punjab and the Federation of Pakistan.
She claimed that she was physically assaulted by female prison staff following her re-arrest and that her detention was part of a wider campaign to target her husband Imran Khan through fabricated cases.
Bushra Bibi’s plea said her sentence in the Toshakhana case was suspended and she was granted bail in the Al-Qadir Trust case.
On 13 July 2024, she was also acquitted in the Iddat case.
Despite these legal victories, she claimed she was arrested again in the new Toshakhana case, which she considered illegal and a violation of her rights.
She further argued that the re-arrest was a violation of Section 17(d) of the National Accountability Regulations of 1999.
Bushra Bibi claimed that she was not given any reasons for her arrest nor was she shown any National Accountability Bureau (NAB) orders denying her the right to know the charges against her.
The petition highlighted alleged mistreatment by uniformed prison staff, which it described as a humiliating and humiliating experience, especially given the absence of a valid arrest warrant.
